Terms and Conditions for Pet Care Services

  

  

Terms and Conditions

1. On Paws Professional Pet Services agrees to provide pet sitting, dog walking, boarding, doggy daycare, and other applicable pet care services in a reliable, caring, and trustworthy manner. In consideration of the services and as an express condition thereof, the client expressly waives and releases On Paws Professional Pet Services from any and all claims against the company, its owners, employees and representatives, except those arising from negligence or willful misconduct on the part of On Paws Professional Pet Services or its employees and staff.

2.  Client agrees to notify On Paws Professional Pet Services of any concerns within 24 hours of completion of services or after pickup. On Paws Professional Pet Services cannot be held liable for any injury, illness, or damage to property after 24 hours.

3. Client agrees to pay all charges accrued for services rendered. For pet sitting & boarding: Payment for services will be due 5 days before services begin, or services will be cancelled. Any pet sitting or boarding requests made less than 5 days before services begin must be paid in full at the time of booking. A card must be on file in Time to Pet. The card will be charged upon the due date. If the card declines, the owner must pay the invoice due prior to the start of services, or services will be cancelled.

For doggy daycare, midday dog walks & potty breaks: A credit or debit card must be on file in Time to Pet and will be charged the day after the last service of each week is completed. If the card declines, services will be suspended until payment is received. If a client calls or emails to request these services, rather than requesting them through Time to Pet, On Paws Professional Pet Services will verify if a payment method is on file. If there isn’t a payment method on file, we will request one at that time. 

4.  Client will incur a $25 charge for each returned check in addition to any and all bank fees attributed to the returned check.

5.  On Paws Professional Pet Services shall exercise all precautions against sickness, injury, escape, loss, accidents, or death of Client’s pet(s). On Paws Professional Pet Services is not responsible for sickness, injury, escape, loss accidents or death of Client’s pet(s) unless caused through negligence or willful misconduct on the part of On Paws Professional Pet Services.

6. Client represents and warrants that pet(s) are currently vaccinated in accordance with all local, state and federal laws and regulations.

7. On Paws Professional Pet Services will follow the directions of the Veterinary Release Form in case a pet should become injured or sick.

8. Client accepts responsibility for all medical expenses and other damages resulting from an injury to any employees or staff of On Paws Professional Pet services, other persons or other animal(s) caused by the Client’s pet(s) or negligent act.

9. Client agrees to indemnify, hold harmless and defend On Paws Professional Pet Services and their employees and staff in the event of a claim by any person injured or otherwise damaged by Client’s pet(s) or negligent act.

10. Cancellation Policy: Due to limited space and because reservations are made to plan On Paws Professional Pet Services availability to clients, On Paws Professional Pet Services reserves the right to charge a cancellation fee for services cancelled within the following time frames and according to the following schedule of charges:

Doggy Daycare: If cancelled after midnight before the start of the scheduled day of daycare, the full charge for the scheduled day of daycare will be due at the end of the week. If the client used a prepaid package for the service, then that day will be deducted from the package.

Boarding: If cancelled within 24 hours of the start of the scheduled service, a 50% cancellation fee of the entire scheduled service fee will be deducted from the prepayment and the balance will be refunded or a credit will be added to the client's Time to Pet account for future services.

Pet Care Visits in Client’s Homes: If cancelled within 24 hours of the start of the scheduled service, a 50% cancellation fee of the entire scheduled service fee will be deducted from the prepayment and the balance will be refunded or a credit will be added to the client's Time to Pet account for future services.

Late Departure or Early Return: If a client is delayed in leaving and delays the start of pet care or returns home early and cancels the remainder of the scheduled pet care, no refunds or credits will be given for scheduled visits that were not completed due to the client leaving late or returning early.

11. On Paws Professional Pet Services reserves the right to terminate this contract at any time if On Paws Professional Pet Services determines that the Client’s pet(s) poses a danger to the health or safety of itself, other pets, other people or the employees and staff of On Paws Professional Pet Services. If concerns prohibit On Paws Professional Pet Services from caring for the pet, On Paws Professional Pet Services will attempt to contact the Client or emergency contact to arrange alternative care. If the Client or emergency contact cannot be contacted, the Client authorizes On Paws Professional Pet Services to place the pet in another licensed kennel with all charges and fees arising to be the responsibility of the Client.

12. On Paws Professional Pet Services reserves the right to refuse service to any client, at any time, for any reason.

13.  This document gives On Paws Professional Pet Services and its representatives authorization to enter the Client’s listed address as needed to perform agreed upon services.

14. The animals that are listed in the Pet Information section of Time to Pet are under the care, custody, and control of On Paws during any scheduled pet sitting or dog walking visit contracted with On Paws. If another person enters the home at any time that does not live there for any reason, while On Paws is contracted to provide pet care, then On Paws is no longer in control and therefore, not liable for anything that may happen to the home or pets. Therefore, if the client requests that a friend, family member or other pet sitter help with pet care during the same time that On Paws is contracted to care for the pets, then On Paws will assume no liability for escape, injury or death to a pet or damage to the client’s property unless expressly caused by negligence of On Paws staff.

15.   The client acknowledges they have provided On Paws with a way to enter the home. If a key is required to enter the home, On Paws will provide a lockbox with a code chosen by the client programmed into the lockbox and placed in the access instructions in Time to Pet. The client may also provide their own lockbox, and the code must be placed in the access instructions in Time to Pet. If the client has a keypad or other keyless entry system they must provide On Paws with any codes or methods of entry by putting those codes or methods of entry into the access instructions in Time to Pet.

16. Client expressly gives On Paws Professional Pet Services the authority to employ a locksmith on their behalf and to promptly reimburse On Paws Professional Pet Services for all costs incurred in the event of a malfunction of the lock, keys or automatic door opener.

17. On Paws Professional Pet Services is not liable for any loss or damage in the event of a burglary or other crime that should occur under this contract.

18.  Client agrees to properly secure the home prior to leaving the premises. On Paws Professional Pet Services will re-secure the home to the best of its ability at the end of each visit.

19. In the case of an emergency, inclement weather or a natural disaster, the Client authorizes On Paws Professional Pet Services to use reasonable judgment for the care and wellbeing of Client’s pet(s) and residence. On Paws Professional Pet Services will make reasonable efforts to maintain service during these conditions but reserves the right to adjust the schedule of service based on the sole discretion of On Paws Professional Pet Services.

20. On Paws Professional Pet Services is not responsible for any damage beyond the control of On Paws Professional Pet Services.

21. Client is responsible for supplying the necessary equipment and supplies needed for the care of their pet(s) including, but not limited to, a sturdy, well-fit harness or collar and leash for walks or in case of emergencies, pet food, medications, identification tags, litter boxes, cat litter and cleaning supplies. Client authorizes any purchase of necessary supplies for the satisfactory performance of duties. Costs of all purchases and related service fees will be reimbursed to On Paws Professional Pet Services within 14 days.

22. Client authorizes the use of pet(s) pictures on websites, social media and/or marketing materials for promotional purposes.

23. This notice and consent are made pursuant to Sec. 824.003 of the Texas Health and Safety Code. Client acknowledges that our boarding and daycare facility is unattended between the hours of 7 pm and 7 am daily. However, there are cameras that are checked regularly after hours and there is a monitored alarm system that connects directly to On Paws Professional Pet Services owner's phone. Client also acknowledges that our boarding and daycare facility is not equipped with a Fire Protection Sprinkler System. However, there are Smoke, CO2 and Flood alarms connected to the monitored security system. Client hereby consents to the Pet being left unattended during the hours listed pursuant to the above notice.

24. Client authorizes this contract to be valid approval for services to permit On Paws Professional Pet Services to accept all future in person, telephone, online, mail or email reservations and provide services without additional signed contracts or written authorizations.

25. The Terms of this document apply to all pets owned by the client, including all new pets that the customer obtains on or after the date this document was signed.
